Action in the Hennepin County District Court wherein plaintiff sought damages allegedly resulting from delay in the performance of a construction contract with defendant The Regents of the University of Minnesota. James Steele Construction Company, the general contractor, was also named as defendant. The regents asserted a cross-claim against the construction company and filed a third-party complaint against United Pacific Insurance Company, surety for the general contractor. The court, Bruce C. Stone, Judge, found in favor of defendants on the issue of liability and dismissed the cross-claim and third-party complaint. Plaintiff appealed from the judgment entered.
